Privacy notice

Mid Yorkshire Teaching NHS Trust (‘the Trust’) is committed to protecting the privacy and security of your personal information. This privacy notice provides important details about how the Trust and its third-party service provider, Jobtrain Ltd, protect the privacy of our candidates, employees, and users of our Jobtrain careers site and applicant tracking system.

This privacy notice explains what information we collect and how we use, disclose, transfer, and store your data on our Jobtrain careers site: https://www.careers.midyorks.nhs.uk.

Please note that it does not cover all external websites that may be linked from this site. Always review the privacy statement of any website you navigate to from our careers site. All other Trust privacy notices are available on the main website

Jobtrain Ltd fully complies with the Data Protection Act 2018 and as a data processor they are registered with the ICO, they will only process your personal data on our instructions and where they have agreed to treat that information confidentially and to keep it secure.

Why we process your personal information and the legal basis for doing so

We process your personal information submitted via the Jobtrain careers site on a consent basis. You may withdraw your consent at any time by deleting your records from your Jobtrain careers account. Please note that withdrawing consent will prevent us from progressing your application further.

The information we hold, and process, is used strictly for management and administrative purposes. We retain and use this data to comply with contractual, statutory, and management obligations and responsibilities.

We have a legal basis to process your data as part of our recruitment processes and your employment contract, whether permanent or temporary.

The legal basis we may rely on for processing your personal information is:

The lawful basis we may rely on for using information that is more sensitive (special category) is:

What information do we collect?

The categories of personal information (as well as more sensitive data/ special category data) we may collect, store, and use about you include:

  • Personal demographics (e.g., gender, race, ethnicity, sexual orientation, religion)
  • Contact details (e.g., names, addresses, telephone numbers)
  • Employment records (e.g., national insurance number, professional memberships, references, proof of eligibility to work in the UK, and security checks)
  • Details of relevant criminal convictions you have been asked to declare
  • Medical information (e.g., disability status)
  • Equality data for monitoring purposes

Sharing your personal information

Disclosures of personal information are made on a case-by-case basis. Information is shared only with agencies and bodies that have a legitimate "need to know" or where we are legally obliged to share it, or where you have provided explicit consent.

We do not share your data with third parties unless your application for employment is successful, and you receive a conditional offer. At that stage, your data may be shared with:

  • Referees, to obtain references
  • The Disclosure and Barring Service, for necessary criminal records checks

How do we store and how long do we keep your personal information

After 12 months of inactivity, you will receive an email asking if you wish to keep your Jobtrain careers account active. If no action is taken, your account will be deleted after 30 days. If you log in and choose to keep your account, it will remain active for another 12 months.

If your application for employment is successful, personal data collected during the recruitment process will be transferred to your employment file. Your information is securely stored for the time periods specified in the Records Management Code of Practice. We will then dispose of the information as recommended by the Records Management Code.

If your application is unsuccessful, limited personal data may be processed to comply with legal obligations. Where possible, this data will be anonymised.

Is information transferred outside the UK?

No data is transferred, it is processed in the UK.

What are your data protection rights?

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information (known as a subject access request (SAR)).

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.

Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.

Your right to object to processing - You have the right to object to the processing of your personal information in certain circumstances.

Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

Through your Jobtrain careers account, you can also review and update your application details to correct any inaccuracies.
